RCSD Supt. Ready To Take Legal Action Against The School Board

Rochester’s School Superintendent, Bolgen Vargas is ready to take legal action against the school board in a sudden escalation of tension between Vargas and the board.

This all came to light Tuesday evening, just before a special board meeting, when a letter was released from Vargas’ lawyer to the school board’s attorney, protesting a move by the board that would change the superintendent’s ability to hire and fire.

At the board meeting, the school board approved a resolution that could remove some of the employees from a group that makes up the superintendent’s higher level administrators, the Superintendent's Employment Group. Vargas’ lawyer says that action violates state law and the terms of Vargas’ employment contract.

School board president Van White says the board is just trying to realign the duties of the superintendent so that it matches up with what his statutory power is supposed to be.

Vargas is now threatening to sue the school board over the issue.
