A state parole board has denied parole to Tyquan Rivera, who was convicted of shooting and seriously wounding Rochester Police Officer Anthony DiPonzio in 2009.
DiPonzio was shot in the head with a .22 caliber rifle in 2009, and went through intensive rehabilitation before returning to work in 2011.
Rivera was 14 years old at the time of the shooting, and was sentenced to three-and-a-third to 10 years.
In its decision, the parole board said it determined that if released, there is a “reasonable probability” that Rivera would not remain at liberty without violating the law; the board says that prior rehabilitative efforts on community supervision failed to deter Rivera’s criminal behavior.
The report also says that while in state prison, Rivera was hit with infractions for violent conduct, loss and damage of property and creating a disturbance.
Rivera will not be eligible for parole for another two years.
