MAYVILLE, N.Y. (AP) — A New York judge has extended an order preventing construction at the storied Chautauqua Institution Amphitheater.
State Supreme Court Judge Frank Sedita said at a hearing Monday he needs more information before determining if the work is major reconstruction or minor restoration.
He extended a temporary restraining order for another week.
The case pits preservationists against the administration of the western New York education and arts retreat.
A group called the Committee to Preserve the Historic Chautauqua Amphitheater and five property owners sued Jan. 22 to block plans to demolish and rebuild the 122-year-old amphitheater.
Administrators say the project is needed to improve access and add upgrades. Opponents say there are other ways to accomplish those goals.
Countless notable figures have taken the open-air theater's stage, including Amelia Earhart, Ella Fitzgerald and Robert Kennedy.
