Feds won't seek death penalty in Xerox Credit Union robbery

The U.S. Attorney’s office confirms it will not seek the death penalty against  a Rochester man accused in a fatal robbery at the Xerox Federal Credit Union in Webster in 2003.

Richard Wilbern was in federal court this morning. Prosecutors were waiting for a decision from the U.S. Justice Department on whether to seek the death penalty for that fatal shooting that took the life of Raymond Batzel.

The 56 year old Wilbern is a former Xerox employee who lived in Fairport at the time of the robbery.

Officials revealed that they were led to Wilbern after a tipster said they had worked with Wilbern at Xerox before he was fired.  

Assistant U.S. Attorney Doug Gregory tells WXXI News if Wilbern is convicted, he would seek the maximum penalty, which is life in prison without parole.

Wilbern is currently being held without bail. A hearing on bail is set for next month.
