A judge has set aside the jury’s verdict in the case of one of the defendants who were convicted in connection with the Genesee Street mass shooting last year.
On Wednesday, Monroe County Court Judge Doug Randall set aside the conviction for Jalen Everett, who had been convicted in November on three counts of second degree murder.
A statement from District Attorney Sandra Doorley says Randall’s decision was apparently based on events allegedly occurring during jury deliberations.
She says when the issue first came to her office’s attention, they were prohibited from investigated alleged improprieties due to a gag order imposed by the court.
Everett was among those charged in connection with the August 2015 shooting outside the Boys and Girls Club that killed three people and injured four others.
Doorley says her office will conduct its own investigation and they plan to take whatever action they deem appropriate.
