A report just released by the Town of Irondequoit fire marshal says that code violations still exist at Medley Centre.
The letter from fire marshal Greg Merrick to officials at Bersin Properties says that while it's evident work has been done to clean up the mall since a broker sprinkler system caused damage to the mall earlier this year, there are still building code violations.
Merrick says during a walk-through at the mall this week he found combustibles including cardboard and furniture in several areas of the complex.
The fire marshal also says Medley Center is still in violation of a code which requires the fire alarm and sprinkler systems to be in working condition.
Merrick also says security isn't enough to keep people from entering the vacant mall, which he says also poses a fire hazard.
Developer Scott Congel issued a statement saying that “ We continue to be shocked with the attitude of the new administration in the Town of Irondequoit, which appears to more motivated by political concerns than actual safety issues…we do not believe there are any public safety issues at a property that is closed, secured and awaiting the start of a major renovation and expansion.”
Congel says his company will be meeting with their subcontractor, building code engineer, and legal counsel to develop an appropriate action plan.
When told of Congel’s response by WXXI News, Irondequoit Supervisor Adam Bello called Congel’s statement “An insult to the taxpayers in Irondequoit. There's a town code in place and it's pretty clear, it was clearly laid out by the fire marshal for the Town of Irondequoit and our code enforcement officers what needed to happen to bring that property up to code and it's unfortunate they didn't do that. "
Code violations filed by the town are due to be heard in town court next week.
