The Henrietta Ethics Board has ruled it will take no action against town supervisor Jack Moore. This comes a week after Moore apologized for making allegedly racist remarks that were recorded by a town employee during a meeting last month.
The employee who recorded the remarks filed a complaint with the Board of Ethics trying to get Moore removed from office. In a meeting on Wednesday, the board ruled that removal of Moore is outside their jurisdiction and has no authority to rule on the matter.
An attorney who advises the ethics board, Mark Costello, says there is a different process the person filing the complaint can take, one which is laid out in the town manual. He says the ethics board is set up just to provide advisory opinions on a range of topics.
In the recording, Moore is reportedly heard saying, "Obamacare is how we're going to pay for your cousins in the city," in reference to the Affordable Care Act.
The incident prompted several local politicians from both parties to call for Moore's resignation. Moore has said he will not step down and has since taken diversity training.
